“Bars and restaurants would be able to hold Texas Hold ’Em poker tournaments under legislation that cleared a House committee Monday. However, Gov. Kathleen Blanco is opposed to House Bill 484, saying the measure would legalize Texas Hold ’Em across the state. More than 6,000 alcoholic beverage-selling restaurants, bars, taverns, cocktail lounges and clubs could host weekly poker tournaments with very little regulation if HB484 becomes law, said Marie Centanni, the governor’s press secretary.”

“Owner Jose Gonzalez-Curiel appealed the decision, has denied accusations of mismanagement and called attention to a February ruling by the state Gambling Control Commission to temporarily extend his permit until the end of May while he shores up his finances. But the state permit does not supersede a city permit. If either is revoked, gambling in Cap’s Saloon would become illegal. Furthermore, no similar operation would be allowed to take its place under existing city code. The council made sure of that in 2002 by approving an amendment preventing any new card rooms – where people gamble on card games such as poker – from opening in the city”
